The personal data that the Data Controller may collect directly or indirectly consists of the following: Personal data considered as identification data are all those relating to the identification of the person (full name, address, landline and/or cell phone numbers, company for which they work, fingerprints, date of birth, nationality, place of birth, occupation and/or their direct relatives). We commit that all data obtained will be treated under the strictest security measures to guarantee its confidentiality.
Purposes
The primary purposes for which we collect your data are to sell products, send promotions, personalize promotions / advertisements, conduct market research, and sell market research.
The secondary purposes for which we collect your data are: billing, collection, informing you about new products, services or changes in them, promotional messages; evaluating the quality of the service; complying with obligations derived from the provision of the service; complying with applicable current legislation; answering requests for information from any authority, whether for investigations, statistics or regulatory reports; addressing your comments related to the provision of services; sending notices and information about our services; and contributing to the process of continuous improvement
Transfers and Processors of Personal Data
Likewise, we inform you that your personal data may be transferred to third parties and may be shared with processors for their treatment inside and outside the country, by persons other than the Controller, who will issue the instructions for their treatment. In that sense, your information may be transferred to or shared with (i) Various professionals, technicians, and assistants, as well as other private entities due to subrogated services in connection with customer care; (ii) Loyalty program administrators; (iii) Commercial partners of the Controller, with the purpose of administering and operating services complementary to those of the Controller; (iv) Companies or third parties that jointly operate with the Controller any product, service, or any software or computer infrastructure that serves as a platform for conducting operations or services; (v) Third-party service providers or vendors of products necessary for the operation of the controller, as well as commission agents who perform operations or provide services to the controller that the latter may carry out in accordance with current legislation and its bylaws, such as, among others, commission agents, data processors, marketing material delivery companies, courier services, security companies, armored car services, advertising agencies, information storage, with the purpose of assisting in the fulfillment of the purposes provided in this privacy notice; (vi) External professionals, advisors, or consultants, for the purpose of administering sales operations, services, and other acts that the controller may perform in accordance with current legislation and its bylaws, as well as for the defense of its interests before any legal controversy arising from said operations and services, such as collection agencies, external auditors, legal, accounting, etc.; and (vii) All government and/or judicial agencies that by law request and/or require the controller to provide personal data of its clients and/or family members, necessary for compliance with various laws.
If you do not express your opposition to your personal data being transferred, it will be understood that you have given your consent for it.
The Controller informs that all service provision contracts with third parties that involve the processing of your personal information on behalf of and for the account of the Controller will include a clause guaranteeing that they provide the level of personal data protection, by which they are constituted as processors in terms of the preceding paragraph. In any case, all handling of personal data will be carried out in compliance with the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter the "Law") and its Regulations.
The information you provide must be truthful and complete. Therefore, the accuracy of the data provided remains your responsibility, and under no circumstances will the Controller be liable in this regard.
Exercise of ARCO Rights
At any time you deem appropriate, you may exercise your ARCO rights (access, rectification, cancellation, and opposition) regarding the processing of the personal data provided, as well as revoke the consent granted in this document. To do so, you must contact us via email at hola@swirvle.com; the procedure and requirements that your request must contain, in accordance with the provisions of the Law and its Regulations, are as follows:
(1) Name and Address; if the address is not included, the request will be considered as not received. (2) The document that proves your identity or the identity of your representative (copy of a valid official ID). The representative must prove the identity of the owner, the identity of the representative, and their powers of representation through a public instrument or a power of attorney signed before two witnesses, or a declaration in a personal appearance by the owner; (3) A clear and precise description of the personal data you wish to access, rectify, cancel, or oppose; (4) Description of other elements that facilitate the location of your personal data (website, branch). The documents must be scanned and attached to the email to verify their authenticity.
